I'm certainly no legal expert, but if there's a surgery or treatment that could expedite his return to football and he's avoiding it then I'd think there could be a possibility of breach of contract. A contract is a two way street with responsibilities for both parties. It already seems very likely that the team has cleared Berry for a return and he's telling them no. He can't just continue to avoid playing and also expect to continue getting paid.
