The Denver Broncos booted season-ticket holders who didn’t go to a single game last season and that led to upgraded seats for 144 accounts and about 400 seats through Monday, compared to only 14 accounts and 39 seats the previous season, the club said. When all upgrades are made, the forced non-renewals also will allow the Broncos to make season tickets available to some fans on the 75,000-person waiting list for the first time in six years and increase its very limited single-game ticket allotment. Last season, 97 percent of the seating capacity at Mile High Stadium came from season-ticket holders, leaving just 3 percent for single games. The Broncos said their legal “weeding out” — based on technology in the electronic ticket resale market — is putting “more tickets in the hands of Denver Broncos fans,” team spokesman Patrick Smyth said Tuesday. But it has outraged some long-time season-ticket holders who question how the Broncos can prove what tickets were sold and why they weren’t warned of the policy. The team denied his appeal, and according to the Broncos’ ticket office, Fletcher’s tickets from 2013, 2014, 2015 and 2016 all were sold on the secondary market and used. “I have tickets showing that I went to games, or I’d let my kids go and buy a handicap seat for myself,” Fletcher said of attending games from 2013-15. “It’s been difficult for me to hold those tickets at times,” Fletcher said. “At times I couldn’t give those tickets away. A season-ticket holder has to give them their money in February of each year. If they’re checking anyone’s tickets, they ought to let people know that and put it in their policy.” He added: “I guarantee you they didn’t take some of these sky-box owners’ tickets back if they didn’t go to at least one game. But how do they know that? How do we know that?” Eric Siegler, who lives in Chicago, said he sold his seats last season to help support his cancer-stricken mother-in-law in Minnesota, who has since died. After being notified of his non-renewal, Siegler wrote an appeal letter to the Broncos, and also had his father, sister, aunt, cousin and three friends write the team. That's a spurious comparsion. The products are not the same and are not consumed in the same way. The only significant inclusive aspect is that one paid money for a service or product. No one was deprived of a product without due compensation. Meaning the Broncos did not remove a reservation for tickets without giving the customer their money back. The idea that someone is entitled to season tickets that have not been paid for, or otherwise not renewed by the football team is hardly some injustice. The only injustice here is people scalping tickets while keeping fans that are waiting for season tickets for using said product at the market value established by the football team.

Is there a clause that says that a person cannot resale their tickets?
If there is no such clause then the donkos are out of line IMO.

Denver's not the only one that's doing something stupid. The Chiefs are also doing something similar to this.

Come on now it was a horrible comparison.
A better comparison is that if you rent a car the owner of the car has every reason to take the car away if you let someone else drive it, as long as it is stipulated that no one else is allowed to drive that car.

No shit Sherlock. But they are using the reasoning of people selling and not attending as the reason behind this policy. If there is no clause making that illegal or against the terms of service then they are not acting by the contract.

SEASON TICKET ACCOUNT POLICIES
1. SEASON TICKET ACCOUNTS A Season Ticket Account is a revocable license issued annually by PDB Sports, Ltd. ('Denver Broncos' or 'Broncos'), as licensor. Season ticket accounts are subject to the terms, conditions and policies (including the 'Fan Code of Conduct'), established from time to time by the Broncos. The current policies may be modified and/or supplemented at any time by the Denver Broncos. Any modifications or new policies will be effective when adopted. Season Ticket Account Holders should not rely upon or have any expectation that the policies presently applicable to Season Ticket Accounts will be applicable at any time in the future. 2. PURCHASE FROM YEAR TO YEAR [RENEWAL] Season Ticket Account Holders are valued customers of the Denver Broncos, and the Broncos will diligently attempt to accommodate its customers. However, the opportunity to purchase season ticket accounts from year-to-year, at any seat location, is a privilege granted by the Broncos, which may be revoked by the Broncos at any time. Neither a Season Ticket Account, nor the opportunity to purchase a Season Ticket Account from year-to-year, constitutes any form of legal or equitable right, including without limitation an express or implied contract, lease, option, right of first refusal, implied trust, or expectancy interest. There is no automatic right to purchase a Season Ticket Account from year-to-year, nor is there any guarantee that this privilege will be offered or granted by the Broncos. Season Ticket Account Holders should not form any manner of reliance on the privilege to purchase a Season Ticket Account from year-to-year, nor there be any prescriptive right to purchase a Season Ticket Account annually. The privilege to purchase a Season Ticket Account from year-to-year is not 'property' and creates no property rights whatsoever under state statutory or common law or under the United States Bankruptcy Code.
