Legal Help - Scam or Legit?
So a few months back, I was stupid --- needed a quick weight loss and ordered some "magic pills" online. Typically I research anything very thoroughly, but this instance decided just to hit the buy button. (I know, I know, anything I put into my body should be very well researched). I admit I was dumber than shit.
That said, the one time purchase I thought I was making turned out to be some type of bullshit subscription (deep down in ton of text in a hidden document on their website). As soon as I saw the occurrence on my credit card bill, I called the company... canceled the reoccurring "service" and then called my CC company whom issued a refund on the scam. I then canceled my entire credit card because this company was fishy as ****. For instance: I called them and talked to "Joe" to get a refund that they said they couldn't do. Then I call right back and talk to the same guy, but this time he changed his name to "Tom". When I asked for a name, and a case #, he had to think a minute and then just started feeding me bullshit Numbers and Letters that didn't make any sense for a case #. Now they are sending me statements below and I'm wondering if there is anything they can actually do to me, or WILL do to me considering we are disputing over a $79 charge. Are they trying to bullshit me into paying them back $79? --------------- The Chargeback you've filed with your Bank/CC company was sent to XXX for a response. Please review XXX response options they are prepared to exercise. After reviewing your case; XXX has all the necessary evidence and documentation to validate your dispute. The refund (Provisional Credit) you've received back to your account is temporary and may be reversed to the Merchant which may incur additional financial penalties and affect your credit if the financial liability resolves with your bank. There is still time to resolve your dispute and avoid an Arbitration and any further actions available to XXX. *Direct Resolution: Cardholders may contact the Chargeback Resolution center to resolve the dispute directly on behalf of the XXX. Your dispute(s) may be resolved immediately by contacting XXX-XXX-XXXX. Main Reasons for Chargebacks Primary reasons Cardholders initiate chargebacks: they are dissatisfied with merchandise or a service they never received the merchandise or service the return/exchange policies weren’t clearly visible they never authorized the charge (or can’t remember) a duplicate charge or a recurring charge doesn’t stop currency conversion rates are unexpected Chargeback Flow 1) A Visa/MC Cardholder contacts the Issuer Bank when they question or dispute a charge to their card. 2) The Issuer Bank credits the Cardholder for the charge while the issue is being investigated, then initiates the chargeback process by submitting a request to the appropriate Card Association (V, MC). 3) Per Visa/MC rules, Merchant’s Acquirer issues credit to the Issuer Bank from the Merchant’s account. 4) The Merchant provides proof that the original charge was valid and/or that credit was already issued. The response back to the Issuer Bank with proof is referred to as Representment or 2nd Presentment. 5) If the charge is proved valid, the money moves back to the Merchant’s account and the Issuer Bank charges the Cardholder. |
