well at least he was smart enough to refuse the breathalyzer at the scene and at the department
he's got enough money to get a lawyer and doing those two things makes it pretty much a layup he'll be able to plea out of DUI |

I highly doubt that. Here at least, the law reads if you refuse a breathalyzer test and a blood test, it's the officers judgement on whether you were intoxicated over the legal limit or not. All the cop has to say in court he was and he can be convicted. Whether a jury would hang him or not is the next question.
