I've watched the first three episodes. To this point it is one of the greatest documentaries I've seen and sets the standard for an analysis of the intersection of race, class, and celebrity in America.

The part that I wonder about is what is the "strongest defense possible"? Obviously, you don't want the state colluding with the defense, but, in Cochran's case, is invoking the Holocaust and directly comparing Fuhrman to Hitler during his close the responsibility of the jurors to see through? Can the prosecution object to bullshit like that presented during a close? Can the judge censure him?

As they said in the West Wing - the United States is advanced citizenship. We put a whole hell of a lot of responsibility on our citizens and one of those responsibilities is to see through that kind of nonsense, yes.

Objections in a close are extremely rare. I suspect it's simply become accepted practice that you don't do it lest it be done to you. And yeah, statements designed expressly to empassion or inflame a jury can be objected to. That said, objecting to it simply creates a 'full stop' to the proceedings and suddenly whatever that statement was is now echoing in a juror's mind. While you're having your silly little sidebar and arguing with the judge, the juror is just hearing "Furman is Hitler" over and over again while the lawyers figure stuff out.

Tactically, it's probably not a great idea to object unless an actual fact is planted. If it's supposition or opinion, I think objecting to it gives it even more weight. And really, it's extremely unlikely to create appealable error so why bother?

What I've always found interesting was the whole "golden rule" thing; you're not allowed to ask a jury to put themselves in X person's shoes. I got absolutely blistered for it in a close during my first mock trial because I had no earthly idea that was a thing.

Like I said, your best bet as opposing counsel there is, IMO, to hope that you've empaneled a good enough jury that their eyes are rolling just as hard as yours are when Godwin's Law is invoked. Experienced trial litigators will tell you that many trials are won/lost during jury selection. I think there's a ton of truth to that.

A black man finally had the resources to not get rail roaded and white America got pissed off. They were not used to seeing a black man accused of doing something to anybody white and get off. Let's tell it like it is. We all know how the word picnic came about. One dude beats the charges and mofos still have not gotten over it, even though he is in jail for some bullshit. You didn't see any outrage from blacks over it either did you? Everybody is burnt out on it. He should have known that they would get him on anything. He still thought white America loved him. Pretty naïve.

Same juror that was on all of those cop killings of unarmed black men. They had video evidence and acquitted in some cases. All I hear is vociferous defending of those cops, despite VIDEO evidence.

Yeah, here's the thing -- no matter how many other black people were wrongly convicted or lynched or enslaved or WHATEVER else you want to say about their mistreatment (and alot could be said)...

OJ actually did it.


And for some insane reason, black people viewed this as a great victory even though he was guilty, and even though he had long ago turned his back on the black community.

It makes no sense. The black community didn't "win". They didn't get anything that day, except a misplaced feeling of vindication because a murderer escaped justice due to the incompetence and stupidity of cops.

I remember being shocked at the incompetence of the LAPD during the trial bit after reading the testimony, there's not s doubt in my mind that a jury had reason to acquit.

I also truly believe that Fuhrman not only planted the glove but that he planted the evidence in and around the Ford Bronco.

He was a racist, dirty cop.
