Internet Sales Tax
Anyone know the rules for Internet sales tax? Doesn't a company have to have a physical presence in the state before they charge you sales tax? I am trying to buy something that I can only get from this specific company in NC. They are trying to charge sales tax on the item when I live in Nebraska. I chatted with them online and they stated they don't have a physical location in Nebraska. I was already thinking this company was a little shady but I am really questioning them now. The only problem is that I have to buy this from them. It is required for a class I am taking.

I would think it would be against the law to state you are collecting a sales tax if you are not actually sending it on to whomever the tax is for. I doubt they are sending the tax onto Nebraska if they don't have to. But I have been wrong before.

That is, in fact, extremely unlikely. Most than likely they are voluntarily collecting and paying the tax in all states to avoid any possibility that they are violating state law.

States are increasingly collecting sales tax on internet sales as brick and mortar sales get displaced.

In most (maybe all?) states, if you make a purchase like the one you described you are required to declare that on your state income tax return and pay the appropriate sales tax with your tax return. I'm not saying that anyone actually does it, but you are supposed to do so. True story.

Technically, even if a company doesn't charge sales tax, you're legally required to pay it anyway when you do your taxes.

No one ever does, but you're probably not going to get very far convincing someone to make an exception to their systems since you should theoretically be paying it anyway.

I encountered this ordering online a couple months back. The first vendor that came up charged a sales tax, but I was able to find another online vendor in another state that didnt. In your case you will just have to pay it sense your product is exclusive to that vendor in that state.

I live on the KS side of the metro. A few years ago I bought something pretty expensive in KC, MO. The guy said that if I had it mailed to me he wouldn't have to charge me sales tax. OK, I said.
So he goes and packages it up...then he hands it to me and asks me if I'd do him a favor and drop in it the mail for him. OK...
