Any Iowa Lawyers On The Board
My wife's nephew got busted with marijuana in his car in Iowa and he had an AR15 in the trunk. They are going to see a lawyer tomorrow but it sounds like he is getting charged with some sort of gun charge to go along with the marijuana charge. I was looking at Iowa laws but the only thing I can find is if he was distributing the marijuana then they could charge him with extra shit. As far as I know he only had a small amount for personal use.

Anyone know the law in Iowa for just possession and having the AR15? Maybe point me to the statute so I can read up on it. More out of curiosity and also so I could fill my wife in on it.

This was my reaction. It's ludicrous that the same thing would be 100% legal in Colorado (and elsewhere), but it could cause the kid serious issues long-term. Hope they can get it handled reasonably.

Careful. In most states even if you have a permit to carry, it’s voided if you are intoxicated. So being high or perhaps having a controlled substance and a fire arm would still be a violation

Generally, but you can get the charges adjusted and plead guilty to a misdemeanor if you have $$$$ and a clean history.

Which according to that it says a "user" in possession of a firearm. Possession doesn't necessarily mean user and if he didn't tell them he was a user is there a chance he gets off with a good lawyer. But for all I know he might have told them he used it. The law fascinates me.

the gun was in the trunk, if the car is not a hatch back it is inaccessible to the driver for the most part. The weed will give them a reason to arrest which in turn gives them a reason to search. Your best course of legal action (besides paying a bunch of money to the scumbag system to make this a defective horn case) is to go after the initial stop. If there was no legal reason for the traffic stop the weed and gun are no longer allowed into evidence.
