It seems to me to be identical to the Plaxico Burress situation. Burress went to prison because of New York's Laws, and effectively ended his career as a result. The question for Talib may not be so much what Goodell does as what a judge or jury does.

I do wonder what Goodell would do if for some reason Talib manages to wriggle out of the legal trouble, though. It's embarrassing for the league and unfortunate that an NFL player is going to damage or destroy his career over such a stupid incident.

I wonder why these guys think they need to carry guns in the first place. A guy like Talib isn't a big enough celebrity that someone's going to do a Mark David Chapman thing on him. So is the gun just an ego thing, or was he involved in other activities that evening that warranted carrying a gun?

That reminds me. Did we learn anything more about the Will Smith thing? I still don't understand exactly what happened there.

You do wonder if Smith's gun caused the other guy to pull out his own gun or if something else was going on. Sometimes escalation is not the best answer.

I can't speak to everything with the Will Smith case, but did read this yesterday from the Post.

Major questions remain about Aqib Talib’s involvement in a shooting in Dallas early Sunday, but as the story unfolds, the Broncos’ cornerback could potentially face penalty from the league and the law.

Talib was expected to return to Colorado on Tuesday evening and report to the Broncos’ training facility Wednesday to be examined by the team’s medical staff. The ninth-year veteran suffered a gunshot wound to his lower right leg that did not require surgery. Broncos trainer Steve Antonopulos has been in contact with Talib’s doctors in Dallas, and coach Gary Kubiak told local media that a timetable for Talib’s return was discussed internally, but he did not provide further details.

“I’ve had many conversations with Aqib since this has taken place, but right now that’s between he and I and the club,” Kubiak said. “Still trying to get more information on exactly what happened, but I’m going to continue to say the thing I’m concerned about is his health and where he’s at physically and where we go to next.”

WFAA TV’s Rebecca Lopez, reported a bullet entered the back of Talib’s right thigh and exited out his right calf. Talib told Dallas police that he was at a park with a large group around 3:40 a.m. when he was shot Sunday, but that “everything was a blur, and I was too intoxicated to remember what happened.”

The Dallas police’s incident reports for Talib and the two other men who were shot, 29-year-old Vernon White and 20-year-old Glen Lumpkin, labeled the offenses as “aggravated assault” at 1311 Empire Central Drive (V Live nightclub) at 2:45 a.m. and stated the suspect was “unknown.”

The full list of unknowns, however, is long and many of them will weigh heavily in determining the potential legal ramifications for Talib. Among them: where he was shot, who shot him, if he was intoxicated, if he was carrying a handgun, if he was licensed to carry a handgun in Texas and if he fired a handgun.

Talib was treated at a Dallas hospital, where doctors presumably drew blood before administering medicine or treating the wound. The tests would reveal if he was intoxicated.

Carrying handguns, openly or concealed, is legal in Texas with a proper license. But it is a third-degree felony (2-10 years in state prison) to carry one without a license at a place that sells liquor, such as the V Live strip club. It is a Class A misdemeanor (up to one year in county jail) to have a handgun while intoxicated, no matter licensing. And it is a Class B misdemeanor (up to six months in county jail) to discharge a weapon in a public place.

While Talib is expected to make a full recovery and physically be able to help the Broncos this season, potential punishment from the NFL could keep him off the field. The current collective bargaining agreement gives commissioner Roger Goodell the power to decide on discipline for off-the-field conduct. The NFL, according to a league source, is investigating the incident.

Talib’s past transgressions could factor into any potential punishment by the NFL if Talib is believed to have violated the personal-conduct policy. In 2009, he was arrested in Florida and charged with simple battery and resisting arrest for assaulting a cab driver, and the league suspended him one game in 2010. In 2011, he was indicted on a charge of aggravated assault with a deadly weapon during a domestic dispute in Dallas, but the charge was dismissed. In April 2015, Dallas police looked into an alleged aggravated assault involving Talib outside a nightclub but suspended the investigation because of lack of evidence.

“I would imagine the league would weigh, to some degree, prior allegations of misconduct, but those allegations should be weighed appropriately, and if there weren’t legal consequences, then that should be a factor,” said Michael McCann, a University of New Hampshire law professor and the director of its Sports and Entertainment Law Institute. “But Article 46 (of the Colorado Bar Association) doesn’t require there be conviction, doesn’t require there be a charge, doesn’t require there be a lawsuit, doesn’t even require there be an allegation. … I think if the league wants to send a message, it would be more about guns and players possessing guns, if in fact that’s what happened here. And if (Talib) was inebriated, I think the league would want to convey a message about that.”

Talib is an idiot and obviously will require a catastrophic event to change his ways, and not even sure that is possible. I would be surprised (given recent issues and previous suspensions) if the league didn't drop the hammer on him. And, who knows what the state of TX will decide to do, but they could really give him issues.
