Yeah, under caution drivers are suppose to be aware of stopped car(s) and safety workers. Tony could of avoided the confrontation as well the bottom of the track was open for him. Again, if you can see the guy clearly on the track from a video from stands, a driver can see him on the track. The light thing is bogus. Been to race tracks 10 times worse.

Considering I watch racing from pits of dirt race tracks 40 nights a year. And from my vantage point many yards outside of the track watch how a car is reacting to the surface to help my drivers make adjustments to their cars, but hey I don't know shit.
