I don't know, i wasn't part of the legal proceedings. I helped him photograph the property, helped him with documents etc. No idea what happened in court. But essentially the tenant was able to drag it on and on via the court system.

He was even able to place a restraining order on my co-worker. Yes, a non-rent paying tenant was able to place a restraining order on the owner of the property. Everytime he wanted to go see the property we had to call the police and request an escort.

This dude was such a **** head.

My co-worker wanted to go inside the property to make sure the smoke detectors were working etc and do an evaluation. We had to have a police escort for that too as well as permission from the judge.

When we got there, the tenant still refused, got on the phone with his lawyer. We waited on the street for two hours while the judge who was handling the case finally forced access, but required the police escort to be there.

Adverse possession was supported as a legal way to promote use of abandoned shelter in order to decrease homelessness and promote constructive use of otherwise neglected property.

Optimally, a structure that everyone else had abandoned and neglected would be inhabited by someone in need, who would then keep the structure and attendant real estate in good repair and perhaps even make improvements.

Reliably though, people found ways to exploit all the procedural protections to extend their right to reside. Properties that weren't actually abandoned were inhabited and the inhabitant refuses to leave until there is a full legal vetting regarding all relevant issues, which a clever attorney will stretch out as long as possible.

So it's essentially a law set up for other reasons that can be used as a work around.

I have heard of crap like this. Someone goes away on vacation-comes back and someone is in their house and it is almost impossible to get them out. Even the police cannot drag them out. Of course states differ-California is bad.

You don't really hear about it much because most don't have the means, knowledge or will power. I don't imagine California is much different than other states in this regard.
