Class action lawsuit filed over Jackson County assessments

KANSAS CITY, Mo. (KCTV) - A new class action lawsuit challenges the quality of Jackson County’s property assessment. It calls into question if some increases are even legal considering some notices came in the mail after the June 15 deadline, as required by state statutes.

The filing asks a judge to step in and offer injunctive relief. It also calls for a jury trial.

The lawsuit was filed by attorney and developer Ken McClain on behalf of Trevor and Amanda Tilton of Odessa and two businesses.

The lawsuit is critical of the methodology used by Jackson County to reach new values. It argues the newly-built assessment system fails to include sufficient information and there’s a lack of physical inspections.

It points out assessments should consider current market conditions. It argues that didn’t happen when it came to commercial property.

The lawsuit claims Jackson County uniformly increased the value of every non-vacant commercial property with an improvement by 25%. And vacant commercial properties had an across-the-board increase of roughly 50%.

KCTV5 has heard from numerous homeowners who are shocked by the large increases in their assessments. Some question if they’ll be able to keep their homes. They also question if they can realistically sell when property tax assessments increase so much in one fell swoop.

There has been a 30% average increase in Jackson County. The Assessor’s Office argues homeowners are seeing large increases because Jackson County real estate has not been assessed with Fair Market Valuations (FMV) for a long time and building costs have increased.

The lawsuit is filed against Jackson County Executive Frank White, Assessor Gail McCann Beatty and other members of the Board of Equalization.

KCTV5 reached out to Jackson County’s public information officer for comment but we have not heard back yet.

I have my assessment at home. Our home jumped in value for sure, but I took the difference between the 2022 and 2023 and it ended up being like $45 per month in additional mortgage payment since ours rolls it in so we don't owe at the end of the year. My house was built in 2012 in a really good neighborhood so I'm not sure if I'm doing the math right. They say you can appeal it, but their office is overburdened (imagine that) with appeals and given any local government entity they're likely short staffed with underpaid workers that don't give two shits about my problems, also I think I read that only 20-24% of appeals actually benefit, but there's added fees to go through a third party appraiser so it's a bunch of government bs. I hope this lawsuit puts them in their place if my monthly mortgage goes up considerably and I did my math wrong. I guess alot of it is targeted at the elderly so the older houses are having their rates go up considerably more than the rates of newer homes. On the news they had a person say her broke down shed was worth $35000 according to Jackson County lol. I'm not sure if Clay County is doing this stuff too, but I'll move across lines I don't care.

no one's property tax rates should go up 54% in a year, let alone 300%, especially when elected officials are getting a break

this is sheer theft by the county, and it is also a non-partisan issue

The properties were undervalued for years. I didn't see anyone complaining when they were paying absolute dick for property taxes. I read an article of someone complaining that their assessment went up like 700% and they showed the YoY assessment. The prior year value was 18,000 and it went up to 120,000. Did these people contact the city in years prior to let them know their property was undervalued?

Unless the county is assessing your property for over what it is actually worth, stop your bitching and pay your taxes.
