How to get someone served?
As it turns out, getting someone served is more of an uphill challenge than I would have expected.
Apparently in counties that will serve a fair number of people on an average day, they will attempt to serve a person twice, then give up if unsuccessful. At this point, they are supposed to return papers to the originating county, but apparently that's too much work as well...they haven't done that yet either, and the service was attemped a month ago. So that leads to my question. Is there another way? I called my local county court to get a status update, and they had not received anything from the serving county, and gave me a number for them to see if I could find anything out. So I called, they said they tried twice, could not catch the guy, and gave up. But they still had not returned papers to my county saying they couldn't serve him. And why couldn't they serve him? Well, they tried twice, around noon-ish, at his home during a weekday. The guy works. I ask if it can be done after 5 and that's not even an option. Apparently if its not 8-5, they just won't do it at all. The lady was actually kind of rude and completely unwilling to even give any advice. So if you have the guys current address, but he's not going to be there during the work day, and you have a county dept that really won't do anything other than the bare minimum to serve him....how in the hell does he get served? Are there other ways? My local county clerk told me if the person was married, that if his wife was home, that would be as good as having him served. But apparently that didn't happen either. So, I'm kind of at a loss. Anybody have any ideas? |

I've seen sheriff's go to work places at all kinds of hours to serve papers.

Yep, same here. When I served divorce papers a few years ago, the sheriff's office as probably the most accommodating people I had ever dealt with. Sadly, that was not the same office as this one. Just talking to them on the phone took monumental effort on their part I think. The sgt is suppose to call me today to offer some insight, but I'm not holding my breath that he will.

Well, I dunno if this is an option but maybe trying to send it via USPS with a signature receipt would work?
