But seriously, this sounds a bit like PETA being PETA and the Florida FWCC saying "OK, fine, we'll look into it."

The shark swam off, so they didn't kill it, and it was a guided tour, so it's unlikely Von would be liable anyway.

Maybe, maybe not. Depends upon the particular shark and what regulations there are about the shark. If the shark is protected, even if they released it, bringing it onto a boat can be grounds for prosecution.

I have represented more than a few guides who, under pressure from clients to get a good fish or trophy animal, break the rules. If that particular shark is listed as threatened, the rules may prohibit any sort of intentional catching or they may just prohibit keeping them.

It is hard to know what is on your line when caught but upon seeing a fish or animal that is protected, the animal should not be brought out of the water but the line should be cut and the fish allowed to leave. PETA is making too much of this by claiming that the shark was killed when reports indicate the shark was photographed and then released.

If the animal was protected, he would likely get the equivalent of a ticket and pay a fine, although there may be circumstances in which he could have to plead guilty to a misdemeanor. This is all extremely fact specific and it isn't clear what type of hammerhead it is, how it was taken or what happened so I don't want to be adamant about an definite outcome. But even if the fish swam away, Miller could face charges in the right circumstances.

You can chuckle about fishing with a pistol and about Talib but most halibut fishermen will take a .410 or a small pistol so they can shoot the fish if it is large enough because a 250 pound halibut flopping in a boat can do some serious damage.

The key is to shoot the fish while it is still in the water. Don't be like the guy who got a large halibut in his boat and then shot it when it started flailing around and his efforts to club the fish were unsuccessful. I understand that he was able to make it back to shore but he needed to weld a patch onto the skiff because of the hole he put into it.

I'm guessing this is one of those "released without harm" clauses/situations. Bringing it onto the boat can certainly lead to harm and land you in deep shit. Well, deep shit for a normal person. A very wealthy highly skilled criminal donkey such as this one has the means to grease up and slide out with a slap on the wrist.

They should hold him indefinitely by strapping him to a plank and forcing him to feed his chickens to sharks in an effort to make up for it. I hope his watch is extra shiny.
