As I said before, if he was impaired more than a couple of beers and well under the limit, they guy should get what he deserves. However, if he was sober or at a really low level, he would most likely not be at fault based on the police report.

It's strange to me because a person can have some drinks but it won't show up in a BAC for 30 minutes or more. Being in a traumatic event could cause a spike maybe but I don't know that. Seems like they want to show he was drunk before he got behind the wheel.
