SCOTUS rejects Arizona's proof of citizenship for voter registration

7-2 decision written by Scalia. Alito and Thomas dissents.

I haven't read the opinion and I'm sure the activists will hail this as some kind of "victory against Arizona's racism", but apparently Arizona lost on a technicality and they could eventually come back to court.

In prior decisions, the courts already ruled that the feds (through congress) decide when, where, and how federal elections are held and what voter registration forms need to look like. Today the court told Arizona that they cant just ignore federal law and use whatever voter registration form they want, they have to use the federal form, but what they can do is follow the proper procedure of asking the board in charge of designing the form to revise it allowing states to ask for proof of citizenship, and if that request is denied, then they could come back to court.

So, nothing was really decided, they punted it.

In other legal news, we had a supreme court decision with a very weird lineup: Thomas had a majority opinion on a procedural criminal law issue joined by the four liberals, while Kennedy and the other 3 conservatives dissented.

The very day he became a citizen he tried to register to vote - sending in the naturalization papers required by this Arizona law. It was rejected. He resubmitted. Rejected again. He submitted another time and went to court.

If all these laws were about was making sure that only citizens could vote - then why was it so hard for this newly minted citizen to register even when he did EXACTLY what was asked?

I call out that idiot every time she mentions the "more votes than voters" thing, which is about every couple of weeks. If I recall correctly, the only piece of evidence she has offered was a story about how X number of "ballot cards" were tabulated despite there being Y number of voters, and Y was much less than X.

Thing is, each "ballot card" was a page of the ballot--and the ballot was two pages. So, each voter filling out a complete ballot would have two ballot cards per person. That was her (failed) gotcha piece of evidence. That, and Aunt Sally or whoever from New Hampshire.

The only major decision announced today was the UT affirmative action case.

The court didn't really overturn anything, 7-1 decision. They did make it slightly more difficult for universities to use AA in admission by saying that there must be no workable race-neutral method available to produce diversity before they can use AA.

We'll probably get the Voting Rights Act and Gay Marriage decisions all on Thursday.

edit: scratch that, the court is going to release more opinions tomorrow morning, and on an unknown third day this week.
