ACLU sues over NSA phone records program

NEW YORK (AP) — Two prominent civil rights groups have filed a lawsuit against the National Security Agency over its program that reportedly collects the telephone records of millions of American customers of Verizon.

The American Civil Liberties Union and the New York Civil Liberties Union say in a lawsuit filed in federal court Tuesday that the program violates First Amendment rights of free speech and association. It also alleges the program violates Fourth Amendment rights to privacy.

The lawsuit additionally alleges the government’s program exceeds Congress’ authority.

ACLU Deputy Legal Director Jameel Jaffer says the program is the same as requiring Americans to give the government a ‘‘daily report’’ of their activities and conversations.


President Barack Obama has defended the program and says privacy must be balanced with security.

People can call him a traitor and treasonous but if he is exposing the Fed Gov's illegal actions then I can't see how he is either? Then again, if what the Fed Gov is doing is legal then dude is in trouble.

True. However, we know how some people in govt will declare things legal even when they're not. Can always find a judge to bend the law for them too.

The authorities who support this stuff, have to get this guy arrested first, so they can shut him up and remove him from the public eye. That's what they're gonna do.

Since 9/11, there has been, at first secretly but increasingly openly, a revocation of the bill of rights for which this country fought over 200 years ago. In particular, the fourth and fifth amendments of the US constitution, which safeguard citizens from unwarranted intrusion by the government into their private lives, have been virtually suspended.

The government claims it has a court warrant under Fisa – but that unconstitutionally sweeping warrant is from a secret court, shielded from effective oversight, almost totally deferential to executive requests. As Russell Tice, a former National Security Agency analyst, put it: "It is a kangaroo court with a rubber stamp."

For the president then to say that there is judicial oversight is nonsense – as is the alleged oversight function of the intelligence committees in Congress. Not for the first time – as with issues of torture, kidnapping, detention, assassination by drones and death squads –they have shown themselves to be thoroughly co-opted by the agencies they supposedly monitor. They are also black holes for information that the public needs to know.

The fact that congressional leaders were "briefed" on this and went along with it, without any open debate, hearings, staff analysis, or any real chance for effective dissent, only shows how broken the system of checks and balances is in this country.

Obviously, the United States is not now a police state.
