North Dakota bans "fetal heartbeat" abortion

There's already only one abortion clinic in the state (Fargo). Under this law, women basically have six weeks after conception to abort the fetus, and considering the amount of time it takes to detect pregnancy, the procedure is now basically illegal in the state.

Wade ruling that legalized abortion up until a fetus is considered viable, usually at 22 to 24 weeks.

Abortion-rights advocates have promised a legal fight that they say will be long, costly and unwinnable for the state.

Arkansas passed a 12-week ban earlier this month that prohibits most abortions when a fetal heartbeat can be detected using an abdominal ultrasound. That ban is scheduled to take effect 90 days after the Arkansas Legislature adjourns.

A fetal heartbeat can generally be detected earlier in a pregnancy using a vaginal ultrasound, but Arkansas lawmakers balked at requiring women seeking abortions to have the more invasive imaging technique.

North Dakota's legislation doesn't specify how a fetal heartbeat would be detected. Doctors performing an abortion after a heartbeat is detected could face a felony charge punishable by up to five years in prison and a $5,000 fine. Women having an abortion would not face charges.

The legislation to ban abortions based on genetic defects also would ban abortion based on gender selection. The Guttmacher Institute, which tracks abortion laws throughout the country, says Pennsylvania, Arizona and Oklahoma also have laws outlawing abortion based on gender selection.

The Republican-led North Dakota Legislature has endorsed a spate of anti-abortion Legislation this year. North Dakota lawmakers moved last week to outlaw abortion in the state by passing a resolution defining life as starting at conception, essentially banning abortion in the state. The measure is likely to come before voters in November 2014.

Representatives also endorsed two other anti-abortion bills last week that are awaiting Dalrymple's signature. One would ban abortions after 20 weeks of pregnancy based on the disputed premise that fetuses feel pain at that point. Another measure requires a doctor who performs abortions to be a physician with hospital-admitting privileges.

Can't say this will be a good thing for Republicans in North Dakota, though. Jack Dalrymple is lucky his election was last November. Maybe people will forget about this or no longer care in 3 or 4 years. If he were up for re-election in 2014, the guy would be ****ed.

I was thinking more of various politicians across the country setting up the party line, and building the platform for 2016.

You're certainly right that ND isn't going to flip to blue over this or anything, but I think that stuff like this can linger in people's minds, especially if it becomes a more widespread issue (other red states try to follow) and/or if it gets lots of press due to court battles.

That can have an effect that spills into border states, especially with Democrats/abortion rights activities highlighting it during campaign season. "Vote THESE guys into office and you know what happens? Look at North Dakota!!"

It's just dumb.

Agree 100%.

I think the problem, for the Republicans, on this issue is that there is a significant percentage of their base that thinks (literally) this is a life or death issue and that they have a moral imperative NOT to ignore this for the sake of the party. Probably in Democratic circles you can get a group of strategic thinks who can convince the anti-gun nuts that they CAN'T keep pushing things like gun legislation because it will kill them in many parts of the country.

I'm not sure that that option/ability really works with Republicans on the anti-abortion front though.

I presume that this law will be struck down within minutes. 6 weeks is far too soon for a ban to survive.

There are still plenty of people that think if they move off or way from their moral convictions to win in politics we all lose.

For most people opposed to gay marriage and abortion there can be no change of heart. These issues define us from them.

I think itís pretty telling of someone who would suggest changing on this just to win. I would rather see someone who is willing to stick to their beliefs no matter what the outcome.

the USA has 1 party. That's the elite. All of this 2 party bullshit is a disguise to fool you into thinking you have free choice. They choose who we can vote for. They hand pick puppets for that. They own us and people eat it up like flapjacks dripping with butter and syrup.

I also believe the terribad public education system is intended (when you compare other civilized societies, not africa or korea).
