SCOTUS to take on allowing Gays to marry. What say you?

There are two cases(DOMA and Proposition 8) to be heard by the SCOTUS this session.

At the base of the question is do gay Americans have the same rights as heterosexual Americans? And if so, do they need their constitutional rights protected at the federal level.

I've never had an openly gay friend, co-worker or family member. I did coach a little league baseball team. On that team I had a player with two Mom's. The players and the parents accepted the kid of the two Mom's as any other player. The other parents let their kids go over to the two Mom's house for sleepovers etc. It wasn't a factor to consider in the slightest.

I don't have any personal experience to know what rights is actually being denied. However, I believe that for whatever reason they were born that way. It's not a choice. You can't pray it out of them. You can't give them therapy and turn them into heterosexuals. They are what they are naturally and we should just accept them.

IMHO, the government/city/state/society have no right to tell it's citizens what two consenting adults do in the privacy of their own bedroom. some of our citizens who they can and who they can't love. Who they can and can't marry. History will not be kind to the discrimination of gays, with cause. It's time to end this era of gay discrimination.

If you want to (you are crazy) and they want to and you are all adults why should it be against the law? There is nothing in the law now that says you can't have 20 children with your wife or 70 children with 15 different women.

Republicans came out against child labor laws. They fought against women's suffrage. Republicans were against Social Security, and the New Deal, the 40 hour work week and giving workers the right to bargain collectively. They stood shoulder to shoulder against the GI Bill. They were livid over LBJ's Civil Rights Act and the Voting Rights Act. Republicans fought to repeal the Glass-Steagal Banking Act of 1933. They were firmly opposed to Medicare and Medicaid. So being opposed to equality of gays is not really a surprise.

My prediction right now, before we hear oral arguments, is that the SCOTUS will rule that the 14th amendment does not allow gay marriage bans, and they will all be abruptly overturned across the country.

However, I also think they will punt on whether gays deserve heightened scrutiny, because they will decide that gay marriage bans do not survive even the rational basis test.

After reading about the arguments, I have to revise my prediction.

Neither side has a majority. The conservatives on the court have lost Kennedy, but the Liberals have not won him over. If he was forced at gunpoint to rule on the merits, he'd probably write an opinion that says gay marriage bans are unconstitutional, but he's not eager or in any hurry to do that. There's almost no chance he upholds prop 8, and he does not like Obama's 9-state compromise.

He wants out, and I think he'll drag the court down the exit ramp, and punt on the larger issue. The SCOTUS will either rule that the prop 8 backers did not have standing to appeal judge Walker's lower-court decision, or they will rule that certiorari was improvidently granted which would allow the 9th circuit decision to stand.

Either way, prop 8 is toast, gay marriage will probably soon become legal in CA, but it wont extend beyond that state, no big sweeping decision.

The DOMA case is far less important, and I have no clue on that one. Gay rights are not really involved there, its purely a federalism issue on whether the feds can use their own definition or has to defer to the state definition. That could go either way, but the impact in that case would be very minor since we're just talking about a few tax dollars here and there, not people getting married.

I disagree with your take that the conservatives have lost Kennedy and that if pressed he'd come down on the side calling gay marriage bans unconstitutional, but I think you're probably calling the outcome right.
