A Pensacola evangelist who owns the defunct Dinosaur Adventure Land in Pensacola was arrested Thursday on 58 federal charges, including failing to pay $473,818 in employee-related taxes and making threats against investigators.

Kent Hovind, who often calls himself “Dr. Dino,” has been sparring with the IRS for at least 17 years on his claims that he is employed by God, receives no income, has no expenses and owns no property.

“The debtor apparently maintains that as a minister of God, everything he owns belongs to God and he is not subject to paying taxes to the United States on money he receives for doing God’s work,” U.S. Bankruptcy Judge Lewis Killian Jr. wrote when he dismissed a claim from Hovind in 1996.

Hovind, an avowed creationist, has widely publicized his “standing offer” to pay $250,000 to anyone who can provide scientific evidence of evolution.

“No one has ever observed a dog produce a non-dog,” Hovind once wrote in reply to a New York Times article.

In the indictment unsealed Thursday, a grand jury alleges that Kent Hovind failed to pay $473,818 in federal income, Social Security and Medicare taxes on employees at his Creation Science Evangelism/Ministry between March 31, 2001, and Jan. 31, 2004.

As part of the ministry, Hovind operated the Dinosaur Adventure Land at 5800 N. Palafox St., which included rides, a museum and a science center. He also sold literature, videos, CDs and other materials and provided lecture services and live debates for a fee.

The indictment alleges Kent Hovind paid his employees in cash and labeled them “missionaries” to avoid payroll tax and FICA requirements.

On Thursday, a message on the Dinosaur Adventure Land telephone welcomed visitors to the place “where dinosaurs and the Bible meet” and stated that the museum and science center were closed temporarily.

The indictment also says the Hovinds’ made cash withdrawals from AmSouth Bank in a manner that evaded federal requirements for reporting cash transactions.

The withdrawals were for $9,500 or $9,600, just below the $10,000 starting point for reporting cash transactions.

Most of the withdrawals were days apart. For example, the indictment shows three withdrawals of $9,500 each on July 20, July 23 and July 26 in 2001.

The indictment also charges Kent Hovind with impeding an IRS investigation.

Among the ways he is accused of doing:

• Filing a frivolous lawsuit against the agency demanding damages for criminal trespass.

• Filing an injunction against an IRS special agent.

• Filing false complaints against the IRS for false arrest, excessive use of force and theft.

• Making threats against investigators and those cooperating with the investigation.

Judge Davis released the Hovinds from custody pending their trial, which will be scheduled during their arraignment at 2 p.m. Monday.

Over Kent Hovind’s protests, the judge took away his passport and guns Hovind claimed belonged to his church.

Hovind argued that he needs his passport to continue his evangelism work. He said “thousands and thousands” are waiting to hear him preach in South Africa next month.

But Davis agreed with Assistant U.S. Attorney Michelle Heldmyer, who argued that “like-minded people” might secret Hovind away if he left the country.

As for the guns, Davis said “ownership was not the issue.”

Kent Hovind also has had run-ins with state authorities.

In April, Circuit Judge Michael Allen ordered the buildings at Dinosaur Adventure Land closed because Hovind failed to obtain a building permit during the 2002 construction. The outdoor theme park was allowed to stay open.

Members of Creation Science Evangelism said at the time that building permits violated their “deeply held” religious beliefs.

While the building permit case was tied up in a four-year court battle, ownership of the theme park was turned over to Glen Stoll, who works with Hovind on legal issues and is based in Washington.

Last year, the U.S. attorney in Seattle filed a lawsuit against Stoll, charging him with encouraging people to avoid tax payments by claiming to be religious entities, according to news reports.

Pensacola evangelist Kent Hovind was sentenced Friday afternoon to 10 years in prison on charges of tax fraud.

After a lengthy sentencing hearing that last 5 1/2 hours, U.S. District Judge Casey Rodgers ordered Hovind also:

– Pay $640,000 in restitution to the Internal Revenue Service.

– Pay the prosecution’s court costs of $7,078.

– Serve three years parole once he is released from prison.

Hovind’s wife, Jo Hovind, also was scheduled to be sentenced. Rodgers postponed her sentencing until March 1 to allow her defense attorney an opportunity to argue possible discrepancies in sentencing guidelines.

The Hovind case, at a glance
The Hovinds were charged with a total of 58 counts of tax evasion.
Counts one through 12 include Kent Hovind’s alleged failure to collect nearly $470,000 in employee taxes.
Counts 13 through 57 include both Kent and Jo Hovind. They are charged with structuring cash transactions of $430,500 to avoid reporting requirements.
Count 58 includes the following charges against Kent Hovind:
Filing a frivolous lawsuit against the IRS, demanding damages for criminal trespass.

Prior to his sentencing, a tearful Kent Hovind, also known as “Dr. Dino” asked for the court’s leniency.

“If it’s just money the IRS wants, there are thousands of people out there who will help pay the money they want so I can go back out there and preach,” Hovind said.

Hovind, founder of Creation Science Evangelism and Dinosaur Adventure Land in Pensacola, was found guilty in November of 58 federal counts, including failure to pay $845,000 in employee-related taxes. He faced a maximum of 288 years in prison.

Jo Hovind was charged and convicted in 44 of the counts involving evading bank-reporting requirements and faces a maximum of 225 years in prison.

Kent Hovind, who is incarcerated in the Escambia County Jail, will be assigned to a prison by the Bureau of Prisons. Rodgers recommended Kent Hovind be sent to the prison at Saufley Field in Pensacola so he will be close to his family.

It will be up to the Bureau of Prisons, however, to make that determination.

In November, a jury found Creation Science Evangelism founder Kent Hovind guilty on 58 federal counts, including failing to pay $845,00 in employee-related taxes.

Another practice that isn't science is embracing ignorance. Yet it's fundamental to the philosophy of intelligent design: I don't know what this is. I don't know how it works. It's too complicated for me to figure out. It's too complicated for any human being to figure out. So it must be the product of a higher intelligence.

What do you do with that line of reasoning? Do you just cede the solving of problems to someone smarter than you, someone who's not even human? Do you tell students to pursue only questions with easy answers?

There may be a limit to what the human mind can figure out about our universe. But how presumptuous it would be for me to claim that if I can't solve a problem, neither can any other person who has ever lived or who will ever be born. Suppose Galileo and Laplace had felt that way? Better yet, what if Newton had not? He might then have solved Laplace's problem a century earlier, making it possible for Laplace to cross the next frontier of ignorance.

Science is a philosophy of discovery. Intelligent design is a philosophy of ignorance. You cannot build a program of discovery on the assumption that nobody is smart enough to figure out the answer to a problem. Once upon a time, people identified the god Neptune as the source of storms at sea. Today we call these storms hurricanes. We know when and where they start. We know what drives them. We know what mitigates their destructive power. And anyone who has studied global warming can tell you what makes them worse. The only people who still call hurricanes acts of God are the people who write insurance forms.

To deny or erase the rich, colorful history of scientists and other thinkers who have invoked divinity in their work would be intellectually dishonest. Surely there's an appropriate place for intelligent design to live in the academic landscape. How about the history of religion? How about philosophy or psychology? The one place it doesn't belong is the science classroom.

If you're not swayed by academic arguments, consider the financial consequences. Allow intelligent design into science textbooks, lecture halls, and laboratories, and the cost to the frontier of scientific discovery—the frontier that drives the economies of the future—would be incalculable. I don't want students who could make the next major breakthrough in renewable energy sources or space travel to have been taught that anything they don't understand, and that nobody yet understands, is divinely constructed and therefore beyond their intellectual capacity. The day that happens, Americans will just sit in awe of what we don't understand, while we watch the rest of the world boldly go where no mortal has gone before.
