Yes yes yes, I'm sure you would be sending Thomas get-well soon cards if the rolls were reversed. And when I'm 1,000% confident that the left would erupt in tears of joy were Trump to keel over, the last thing I'm going to listen to is a scolding on this front.

Turthfully, I'm not going to root for the woman to die. She's has been a dedicated public servant for a long time and deserves to go out on her own terms; ideally quietly in her sleep. But if she does go, I'm gonna be damn pleased that we have the people in place to fundamentally alter the court for a generation.

Honestly - RBG holding on may be BETTER for Trump's 2020 hopes. The country may well be shifting left on a lot of issues but it's is loudly showing that it is in favor of conservative SCOTUS justices. I still believe Scalia played a huge role in the 2016 outcome and the recent Senate races sure suggest same.

It may be preferred to have the possibility of replacing RBG as a carrot to dangle in front of the electorate in 2020. Because I'd be pretty damn surprised if she made it another 6 years.

  1. The wise latina has health issues.
  2. Breyer's 80 years old and could decide to retire at any time, just like Ginsburg
  3. Ginsburg's 85 and will always be ripe for the "My body's telling me it's time" moment

There's blowing it off and being realistic. And the Supreme Court was lost the minute they confirmed Kavanaugh.

I'm actively counseling clients to avoid taking anything to the Supreme Court, so as not to create a venue for creating more conservative law. We're really going to be all about state courts, for the next generation.
