Mueller: New indictments filed against Manafort names ally with Russian intel ties

(CNN)Prosecutors have filed a new indictment against former Trump campaign chairman Paul Manafort that also names as a defendant Konstantin Kilimnik, a close business colleague of Manafort's who prosecutors have said has close ties to Russian intelligence.

The indictment includes two new charges against both Manafort and Kilimnik: a count of obstruction of justice and a count of conspiracy to obstruct justice, meaning the two allegedly worked together to tamper with witnesses.

Kilimnik, 48, of Moscow, is the 20th person to face charges in special counsel Robert Mueller's investigation. So far, 20 people and three companies have been charged.

Earlier this week, Mueller's office accused Manafort of attempting to get witnesses to lie for him in court. A witness told investigators recently that Manafort wanted them to commit perjury about a lobbying effort they worked on for him in the US, a filing in DC District Court said.

Manafort is currently out on house arrest and a $10 million unsecured bail. He awaits a trial in Virginia that is scheduled for late July and a trial in DC scheduled to begin in September.

Manafort has already been charged with conspiracy against the United States, conspiracy to launder money, unregistered agent of a foreign principal, false and misleading Foreign Agents Registration Act statements and false statements. Friday's indictment does not change the counts already against him.

This is the right question to ask. If Manafort had information about actual collusion* between Trump and Russia, Manafort would have already flipped on Trump or someone else. All they can come up with is process crimes from years before Manfort was involved with Trump's campaign. This strongly suggests that the information Manafort has does not support what Mueller wants.

Pay attention to the timeline. A timeline in a white collar case is usually a critical piece of evidence. One of the first things I do when I get such a case is to map out the timeline. And the timeline in this case does not support the official narrative. Texts between Strzok and Page show the investigation into Trump started before the 'official start date'. Texts between Wolfe and Watkins show a focus on Page before he was affiliated with the Trump campaign. The timeline with the Manafort's indictments do not match up with Manafort's crimes having anything to do with the Trump campaign.

Personally, I've fought the DOJ for years and it is a pleasure to watch them self immolate.

What is interesting is that people on this board are watching 2 different movies from the same facts. Those who don't like Trump view this indictment as more 'proof' that there is something to the Mueller investigation.** Those who like Trump view it as more 'proof' that there is nothing to the Mueller investigation. Neither side is going to persuade the other and I seriously doubt that there will be a peaceful resolution to this.



* just a reminder, collusion isn't a crime

** as someone who has practiced in federal court for the better part of a 25 year legal career, none of the indictments in this case are proof that Mueller has anything. He may have something. Feds usually keep matters very close to the vest and he may be hiding what he has. Typically, though, the indictments or plea agreements include sufficient facts as to alert other targets about what they have. This is done so the other targets will come and seek some sort of immunity/plea and help build a case against others. Instead of revealing more and more details of a conspiracy involving the Trump campaign, though, Mueller's indictments are starkly silent about Trump's activities. Considering we are more than a year into the investigation, this is making me think more and more that Mueller has nothing. Indeed, the more that time goes on, the worse it looks for top DOJ officials in investigating the Trump campaign.

If that is the case, why does no one else have that information? Why are the indictments limited only to process crimes from years ago? Why did they not indict Manafort for activities involved with the Trump campaign?

Looking at Manafort's case by itself, it would be reasonable to think that Manafort is hoping for a pardon is he remains silent. Looking at the pattern of indictments and plea agreements and what they are using against Manafort, though, I think even if Manafort thinks Trump will pardon him, Manafort does not have information to support finding that Trump's campaign colluded with Russia.

I had a case a few years ago with a large drug-distribution conspiracy. The government wanted RICO charges against this conspiracy. They rattled that saber and did what they could but this group had known each other since they were kids. No one flipped. Because no one flipped, they didn't have enough to charge RICO. They still got convictions but several were for much shorter time periods because they couldn't use RICO.

Here, though, there is no conspiracy of silence. Papadopolous is working with the government. Cohen's partner is working with the government. They have subpoenaed several other people who have lawyered up. My estimate is that they have several other people who are working with the government. So why nothing on Manafort other than the process crimes? Why do the plea agreements and indictments no list any sort of criminal activity by Trump, Don Jr. or other members of his campaign?

Again, Mueller may have that evidence but by this point in an investigation, I would expect something to be showing up in the indictments and plea agreements. I hate to use the 'dog didn't bark' argument but that silence to me is deafening.
