If they do not have the photo and cannot prove it exists, I fail to see how they are gonna prove blackmail.
The prosecution says the photo exists and that they will have it in their possession before the case goes to trial. Seems pretty straightforward to me. If they can’t produce the photo, they’ll probably be unable to prove their case.

They also asked for an extra six months to prepare their case, which the judge denied.

Common sense says to me that you would have your most important piece of evidence in place before seeking an indictment.

If they do not come up with the photo and the case gets dismissed, this basically becomes a political witch hunt, and the DA in the case should be booted out of office come election time. They are looking completely incompetent here.

What do you know about the statute of limitations on this crime, when it is up, and why that would matter on bringing this case forward immediately?

What you apparently fail to understand is that you need probable cause to get an indictment. You need incriminating evidence to get a conviction when the case goes to trial.

If there had been probable cause to suggest that Hillary had committed a crime, she would have been indicted. Pro-Trump crowds chanting "Lock her up!" doesn't really constitute probable cause.

Wow!! Wasn't a couple weeks ago I was making the argument that, although I was willing to let her fade into retirement for the health of the political discourse, Hillary needed an indictment and a prosecution so people wouldn't revise history to claim vindication.
