So what? The only reason that even happened was that it was politically do-able, largely thanks to the amount of floundering that happened during Obama's watch. If he was at all competent as a president, nothing like that would have ever been possible.

The democrats originally turned the SCOTUS confirmation hearings into political theatre, and have lead the arms race on it to where we are today.

The modern era of nominations started with the Democrats defeating a Nixon appointee purely in retaliation for the Republicans defeating a Johnson appointee's elevation to Chief Justice. (which justice later had to resign in disgrace). The Borking, refusal to give a vote to (Bush lower-court) appointees, the nuclear option, are all Democrat inventions.

Just like with the Byrd rule/reconciliation and all sorts of other ugly precedents in parliamentary tricks, they want to use these things whenever they're expedient. They change the rules to suit them, and then wail when the Republicans just play by the new rules.

Notice how certain question aren't being asked, by both the left and right. Questions that seriously impact liberty at home. What I would ask of the nominee if I were a senator, which I hope Rand Paul does to at least make people think are:

Vital national security issues such as:
  • The Constitutional power to declare war
  • Habeas Corpus
  • Warrantless detention
  • Warrantless surveillance
  • Torture
  • Rendition
  • National security letters
  • The Constitutionality of Continuity of Government (COG)
  • Covert operations of the intelligence agencies

Pay particular note to the Continuity of Government (COG), since this is not just any Washington insider, but a Bushie who was an anti Trumper. This is where Trump's enemies in his own party, even his cabinet, could also remove Trump from power.

Since it wasn't just the Federalist Society that put him on the list, but Kavity was also pushed by the NeoCon dominated Nat'l Review's Whelan, then he may not be all that true to the original intent of the Framers and he'd likely defend foreign mischief abroad.

Anyhow, those questions are just as important as immigration, restraint of federal govt power and restoring federalism.
