Michael Brown's family: gets $1.5M settlement

I almost spit out my coffee this A.M. when I saw that on the CNN scroll. Dude attacks a cop sitting in his car - proven by DNA and ballistics evidence - gets killed by the cop (who was exonerated).....the DOJ says his civil rights were NOT violated.....and still gets a settlement!?!?!?!?

City of Ferguson pays out big money to settle Michael Brown wrongful death suit
The city of Ferguson paid $1.5 million in the settlement of the wrongful death lawsuit filed by the family of Michael Brown. Brown, 18, was shot by police in August 2014, which sparked to protests in the city.
The city attorney for Ferguson, Missouri, has disclosed the settlement amount in the wrongful death lawsuit filed by the family of Michael Brown.

Attorney Apollo Carey told The Associated Press Friday that the city’s insurance company paid the family $1.5 million to settle the lawsuit. The settlement was first announced Tuesday, but figures of the settlement had not initially been disclosed.

The 18-year-old Brown, who was black, was fatally shot in August 2014 by white Ferguson police officer Darren Wilson. Though Brown was unarmed, credible witnesses during the grand jury trial said 6-foot-5, 289 pound Brown charged Officer Wilson, who fired 12 shots at Brown, critically wounding him several times.

The Obama Department of Justice also concluded that Brown’s civil rights were not violated by Wilson in a report that cast serious doubts on the “hands up, don’t shoot” narrative.

People are reliably way better at griping about shortcomings than developing practical solutions.

People have disputes and our society strongly prefers they resolve them legally, properly and bindingly under the law. Often their disputes are complicated and require expertise to advocate properly.

What's the right or privilege you would sacrifice to eliminate these disputes?

A big part of the solution is as simple as reducing union power to allow for a more equal, transparent, independent dispute resolution and one where resolutions are actually binding instead of repeatedly overturned by union appeal. Not a process that's extremely tilted to one side.

One of the fundamental problems is that there is no i centive not to sue or bring frivolous Unnecessary , exaggerated suits.

If the penalties were harsher for losing, and the plaintiff / plaintiff's counsel had to bear the costs of losing...you might see less suits...and more insurance companies fighting them.

But i cant blame them for not fighting, with the system as it is. In this case, if it was going to cost a million dollars to fight....and you risked 10,000,000 in a jury award...why not just settle without a fight and pay 1.5 mil.

Easy business decision when youre going to have to pay that much to fight, and odds are high that your sude will not recover any of it because your side is 5% at fault or something.

I just think there needs to be more incentives not to sue and more ways that plaintiffs should be made to pay when they lose, to even the odds a bit

Let's be clear about something...
The "odds" are only good if you get a billion retweets and public attention. Or if you have money. The odds are horrendous if not. Legit grievances continuously get ignored or covered up.

We need something that at least resembles an independent arbiter. If more citizens have disputes resolved fairly, we'd see less need for taking expensive legal measures. But that doesn't happen. Police control data, they control the investigation, they have power to make plaintiffs powerless.

Just to clarify, im not only talking about lawsuits against police...im talking about all lawsuits. I dont really have any experience with suits against a government agency, and I have heard it is more difficult in some regards...my rant was mainly about more typical ambulance chaser types

I'm honestly not trying to attack, but that is unfounded supposition that subverts some pretty foundational notions about the very notion of civil redress of grievance and dispute.

More importantly, it's completely tangential and largely irrelevant to the initial criticism that the pretrial and discovery process is so expensive as to pervert incentives.

By all means, everyone feel free to explore the suggestion. But it needs to evolve beyond 'hey, here's a thought. . . why don't we . . . '

Add to it we are pretty much at "guilty unless proven innocent", and few statues of limitations, it's even worse.

Must suck for Darren Wilson, wherever he is, or whatever he's doing now, to have his life and profession completely ruined. Because rather than sticking up for the police officer, Obama and the race baiting goons in his admin wanted to protect the image of a thug pos criminal who robbed a convenience store and then disobeyed cop's orders, then charged at and fought said cop and went for his gun. All so they could help incite a race war in this country. Thugs were bused in from out of town and paid to riot and cause civil unrest, funded by Soros (BO's puppet master) backed groups. Obama is truly a piece of shit.

Then entire BLM movement was created out of all of this. Out of a false narrative stirred up by the Obama msm.
