Michael Brown's family: gets $1.5M settlement

I almost spit out my coffee this A.M. when I saw that on the CNN scroll. Dude attacks a cop sitting in his car - proven by DNA and ballistics evidence - gets killed by the cop (who was exonerated).....the DOJ says his civil rights were NOT violated.....and still gets a settlement!?!?!?!?

City of Ferguson pays out big money to settle Michael Brown wrongful death suit

City of Ferguson pays out big money to settle Michael Brown wrongful death suit
The city of Ferguson paid $1.5 million in the settlement of the wrongful death lawsuit filed by the family of Michael Brown. Brown, 18, was shot by police in August 2014, which sparked to protests in the city.
The city attorney for Ferguson, Missouri, has disclosed the settlement amount in the wrongful death lawsuit filed by the family of Michael Brown.

Attorney Apollo Carey told The Associated Press Friday that the city’s insurance company paid the family $1.5 million to settle the lawsuit. The settlement was first announced Tuesday, but figures of the settlement had not initially been disclosed.

The 18-year-old Brown, who was black, was fatally shot in August 2014 by white Ferguson police officer Darren Wilson. Though Brown was unarmed, credible witnesses during the grand jury trial said 6-foot-5, 289 pound Brown charged Officer Wilson, who fired 12 shots at Brown, critically wounding him several times.

The Obama Department of Justice also concluded that Brown’s civil rights were not violated by Wilson in a report that cast serious doubts on the “hands up, don’t shoot” narrative.

A lot of cities actually carry insurance for this kind of thing...IMO it's too bad cities don't take the approach I've heard WalMart does...you slip and fall in our store? No automatic payout; we're going to court and you're going to have to prove our negligence. Probably eliminates a lot of ambulance chasing attorneys out there.

I wasn't aware of that. It's a good policy. Too bad more companies don't follow suit. Of course, few have Walmart's resources to make it work.

Insurance companies don't fight ambulance chasers to any significantly higher degree than anyone else...its just simple math usually...if it's cheaper to settle than fight, you almost always settle....they don't care about the principle or if their client did nothing wrong....they settle as cheaply as possible and try to scare their client as much as possible to kick in cash out of pocket to help settle

Can the city's insurance fight this?

This is pretty egregious, and really takes away from the REAL police abuse.

They can but paying the lawyer 500k and paying the browns a million is cheaper than fighting....and if a jury decides to feel.sorry for the browns that day it could be 10x worse

So they make a business decision and just raise Insurance rates on us...zero risk

Yep that's exactly what it is. The trial would be in the hood, hence the jurors would be from the hood. Theyfind folks in that area don't like the po-po much so they could easily stick it to the city just for the hell of it. I know why they did it but it's still a truck load of bullshit.

i knew i was forgetting something else, but the point stands.

this family should be getting a bill, not be getting paid.

if there were procedural missteps then as with all other aspects of the case, should be reviewed internally and policy changes should occur.

Because when you do that as a government the threat of a pattern of civil rights violations comes up. You see the Supreme Court gives government immunity up until the point where multiple civil rights violations occur, a pattern of it, then the judges are free to hold individual members of the government liable for damages since they should know better after x number of lawsuits were found for the plaintiff.
