SC Justice Kennedy to Retire. Trump to select replacement.

Just crossing the wires that Kennedy will retire. Libs having a bad week with SCOTUS.

Like I said - I wish for her sake that she'd have just stepped down in 2014. I think she enjoys her rockstar status as the 'notorious RBG' but we've seen her fade in the public eye over the last 5-6 years and it's not pretty. Now she's going to stay seated for longer than I'm betting she would have preferred and if Trump does win in 2020 there's little doubt that Ginsburg becomes the 3rd justice to die on the bench in the last 15 years or so.

Just hate to see it end that way.

Some people are going to look awfully petty and shitty if they want to go to the mattresses with her. Democrats are almost certainly going party-line anyway and perhaps Trump won't risk putting someone who appears to be extremely pro-life up for nomination with some R Senators that may not be willing to support her in an election cycle in more pro-choice jurisdictions.

Allison Eid may be a little more likely to slip through.

Personally I'm a huge fan of Willett but good luck trying to get another Scalia on the bench to replace Kennedy. You can try to argue that Roberts effectively replaces Kennedy as the swing vote and that Willett is just putting a reliable conservative on the bench, but you probably won't get much traction.

The whole thing will be fascinating. I would love to see a female constructionist with no real abortion track record to speak of get the gig as I'm not someone who's interested in re-litigating abortion for the rest of my life and I'm a little tired of the optics of Republicans just putting white dudes on the bench (though Bush tried with Miers and thankfully that didn't go through).

IDGAF give me another Gorsuch

Seen some ideas that Brett Kavenaugh would be high up on the list. After reading a bit about him, I dunno that he could get thru, but who knows.

People really need to read up more on Roberts. The guy's gonna be Rehnquist. When Rehnquist was an associate justice he was far more conservative than Roberts is now, IMO. But when he took over as Chief (Berger?), he moved very much into the moderate camp. He was still more conservative than he wasn't, but he moved to the center in a big, big way.

Look at the relationship he formed with Ginsburg and you will see the template for what Roberts and Kagan will almost certainly be in the years to come. Those are two ideologically opposed but extremely well qualified, serious justices who will lead their respective blocs. And in the end this court will be almost a carbon copy to the Rehnquist Court that trended conservative but hardly sent the country into a dark age.

Besides, if Obama got to put Sotomayor on the bench, Trump could put the local dog catcher on and I wouldn't be too heartbroken over it. Obama got his unqualified lapdog so hey, might as well give Trump one as well.
