This is where I'd piss off the right something awful and frankly I know it would backfire like crazy long-term.

But if RBG died, I wouldn't want to replace her with a hard right justice on the bench. You'd paint a target on the back of the party for as long as they held the court. The 'Damn Dirty Conservative Courts' would be the thing that caused every evil in America and I think you'd have some real problems holding Congress for the foreseeable future or getting/keeping the White House.

Frankly, I respect Garland. And if a liberal justice needed to be replaced, He'd be on my list. Now Trump could never EVER do that. And even if he did the Democrats would replace Thomas with some raving far-left lunatic the first chance they'd get. So there's no sense in trying to engage in 'fair play' here.

Practically speaking, it's a complete non-starter. But somewhere deep down in my little Judicial Optimists heart of hearts, I'd like to see something like that happen and actually work out. I don't think anyone wins when one party dominates the SCOTUS either.

Well, I mean, unless you put enough conservatives on there to make the 10th Amendment means something again. That would be okay.

I mean, I don't think your premise in re: aborting black babies to clear the decks for latin babies stands up (because afterall, what stops them from having both?), but that's an area of study I may have to look into a bit more.

If anything appointments made by so-called conservative Presidents, haven't always been reliably conservative as in strict originalist construction — UNLIKE the ones Democrats choose which are reliably in the judicial activist camp. You, of all folks, should know better. It's why Democrats scream so loudly about wanting nominees to support precedent more than anything—even more the Constitution.
