I think he's generally a textualist. I think he's definitely anti-regulation. But in the end, I think he's probably another Kennedy in that he's not gonna be a guy we can just count on to take a conservative position.

That's the damn shame of the conservative outlook on Judges. Even when we win, we don't really 'win' as much as we simply come up with a defensive hold and get the ball back in the hands of the offense. A truly 'conservative' view is going to largely lien towards telling lawmakers to make the law and stay within their lane. So ideally, a court of strict conservatives simply attempt to avoid making law from the bench and leave it to the legislature.

Whereas a strictly liberal court would become a super-legislature. They would do that 'living document' shit and simply unilaterally change the protections afforded by the Constitution to suit their views. If they can't win in Congress, they'll win in the courts.

We only really draw even when we win. And in Kavanaugh, we got a guy that is likely to create that draw more often than he doesn't. But I'm not wholly convinced he won't give the D's a handful of wins. What makes me feel a little better is that his general judicial philosophy seems to be 'regardless of what I think, it's not my job to determine policy' so that should lead to a LOT of relatively conservative decisions.

We shall see.

During a talk at Princeton University on Friday, Supreme Court Justice Elena Kagan expressed deep concern over the legitimacy of the Court after Justice Anthony Kennedy retired. Kagan is concerned that the “middle position” — also known as the unpredictable vote – is now gone and Kennedy could be replaced with someone (Judge Brett Kavanaugh) whose views fall more on the conservative spectrum.

Kagan explained that Kennedy and Sandra Day O’Connor did something important for the Court: they made it look “impartial and neutral and fair.”

“Part of the Court’s strength and part of the Court’s legitimacy depends on people not seeing the Court in the way that people see the other governing structures of this country now,” Kagan explained. “In other words, people thinking of the Court as not politically divided in the same ways. It’s not an extension of politics, but instead somehow above the fray.”

Than WHOM???!?!?! Sotomayor? Jesus Christ - the last time the Democrats had a skate to a nominee they put forward the least qualified jurist on the bench exclusively BECAUSE she was a partisan hack. You want to ask if the Kavanaugh nomination, a ridiculously moderate judge who agreed with Marrick Garland on 90% of their rulings, is going to risk a MORE partisan Judge than Sonia Sotomayor??!!

I mean I guess "Associate Justice Barack Obama" might be slightly more partisan than Sotomayor but....probably not. I just don't see how one can be more partisan than the person they put up there last time they had a shot at it.

Well presuming the odds of re-election are, what, 55-60%, that takes whatever the odds of an open seat are and reduces them accordingly.

I think there's about a 50/50 shot that the left manages to keep their 3 shakier justices alive for another 6 years and I think there's roughly a 50/50 shot Trump wins re-election. So combined probability put me around 25%. Beyond that, I say the odds of him having a Senate majority at that time are less than either of those.

You're not gonna get a conservative of any stripe through a Democratic Senate to replace RBG, Sotomayor or Breyer. Garland is probably the best he could do.

The odds of him getting another SCOTUS appointment may be higher than 25% but I won't say higher than 40%. And the odds of him being in a position to get ACB through when he DOES get that shot are substantially lower than that again, based on nothing more than combined probability.

And for the record - if Kavanaugh does nothing more than rule against the legality of 'National Injunctions' by district courts, his nomination will be a success.

The fact that a lower federal court can issue a universal injunction to stop federal law across the country is absolutely asinine. I see no way to argue that they have the authority to do so as I simply do not believe it's supported by Article 3. It's a strictly policy-making measure made by lower courts and they only EVER use it in attempting to decide a political issue. That's how you know they're being mis-used. As the courts have gotten more and more politicized, their use has skyrocketed.

The SCOTUS needs to put an end to that shit immediately.

They came to her house and she got right back up and went to work or started traveling just after iirc. She was fine.
