If the Democrats win the senate...

Imagine this scenario:

Dems win the senate (not super likely, around a 30% chance)
Kavanaugh goes down (also probably around a 30% chance)

and they get control of the Senate with an open supreme court seat.

Then they say either:

a) We'll only confirm garland or
b) We'll only confirm someone to the left of garland

I'm sure everyone here would just "oh sure, fair's fair. That's within the rules of the senate." Right?

If the Democrats win the Senate Bernie Sanders could become the Senate Budget Committee Chairperson.

Think about that one.

With a new court that is likely to allow politicians to put up more restrictions, if not outlaw it completely, it will be interesting to see if you start getting large numbers of pro abortion rights single issue voters.
If it is outlawed completely, I expect there'll be a massive swing to the left. Think that it has been legal for a long time now and in all this time, and in much more conservative years, it's never been overturned. With a much more liberal electorate than it was back when it was made legal, I absolutely expect some massive left mobilization if it's outlawed.

RGB is 85, yes.

Breyer is 80, no spring chicken.

Thomas is 70, not on death watch by any means but he's the longest tenured SCJ with 26 years on the bench. He could decide to retire and enjoy the fruits of his labors if he knew the POTUS would select a young constitutionalist to fill his very large conservative shoes.

Interesting times. For good or for ill change will continue to come.

It will not surprise me at all to see the Ds take up efforts to expand the SCOTUS once they regain power if the percentage of constitutionalists gets much higher.

The key thing here for R's is not to relax if BK gets confirmed. We R's need to keep working to get out the vote. Over the last month the "energy" polls showed it closing from 78-60 to 82-80 with the D's up. Vote and take a neighbor or two to the polls if they have trouble getting there. Make sure everyone is encouraged to get out and vote. Otherwise you got 2 years of gridlock like you've never seen.
