Bad Cop?

I'm usually on the side of cops but this guy seems to me to be overstepping his authority. He arrests a nurse for not letting him take blood from a unconscious patient...which looks like is hospital (hippa?) policy. Anyone know the law on this? Sorry for the link; don't know how to embed on my own; didn't have an embed option on the video.

Oh it gets worse. The guy they were trying to get blood from? He was the victim of a car crash when someone fleeing from the police in a high speed chase swerved into his lane and crashed head on into him.

The Supreme Court says that blood can not be take without consent or a warrant. The cop had neither. The hospital of course knows this and has it written into their guidelines because they know if they allow their ass is on the line.

My guess is that the police were looking for drugs or alcohol in the guys system to potentially head of a lawsuit that could come from the crash.

Plus, their guidance was written between the hospital and the PD. Not like the hospital went out on their own with this.

Really, doesn't matter if they wrote it with the PD or not. If they consented they would be liable. They of course don't have the taxpayers to pick up the tab for them if they are found liable.

I understand that. I was just pointing out that in addition to it being constitutional law, the policy was written WITH the PD.

Did they actually get to the guy to get his blood? There was no excuse to get this guys blood other than trying to cover their own asses. This looks bad on all fronts from them.

Why would someone need to have been on the street to know the applicable law in this situation? This was not some guy that got pulled off a farm in the Utah Territory by a sheriff who deputized him in desperation because all of the other men in the county were terrified of this law-abiding nurse and it was absolutely necessary to stop her and her law-abiding ways.
The cop presumably was trained before becoming a sworn law enforcement official. The Constitution is not that long. It's pretty easy to read. I don't think a cop would need to have been on the street to figure out what is or is not an unreasonable search and seizure and what is or is not legal.

This is stupid. Police misconduct doesn't go by seniority. The guy ****ed up, and ****ed up hard. He should be punished to the limits of the law.
