The NFL is going to reject Tom Brady’s appeal and uphold the four-game suspension he is facing for his alleged role in Deflategate, according to one report.

Stephen A. Smith said on ESPN’s “First Take” Tuesday morning that a source told him Roger Goodell will not reduce or overturn Brady’s suspension. Perhaps more shocking, Smith cited a separate source who told him Brady actually destroyed his own personal cell phone rather than just refusing to turn it over.

We have known all along that the bigger issue here is Brady’s lack of cooperation during the Ted Wells investigation. The NFL was furious that Brady wouldn’t give up “relevant” text messages and emails that might help clarify his level of involvement — or lack thereof — in Patriots equipment managers allegedly letting air out of game balls.

Smith clarified that he was told by one source that the NFL is going stand by its four-game suspension within the next 24-48 hours, whereas the information about Brady destroying his cell phone was just “something I heard.” It was almost as if he was downplaying the information knowing how much of a bombshell the rumor was.

Reports in recent weeks have been all over the place regarding Brady’s appeal. There has been some indication that the two sides are working toward a settlement, though reports like this one make that seem unlikely.

If the NFL upholds the suspension, no one would be stunned. If someone can prove that Brady destroyed his cell phone, that would be tough for the New England Patriots quarterback to explain.

As mentioned, several other physicists came to a different conclusion than that of Exponent, the firm hired by the Wells investigators.

And while I agree that "Deflator" certainly sounds damning, the physical evidence is inconclusive, so all that's left is opinion.

Which is exactly what the Wells report couches it as. Hell, that's all most court cases end up being, especially those with a preponderance standard.

There are physicists that back both sides, yes. And even if you're not willing to 'pick' the science you prefer, don't you then have to just start looking at corroborating evidence? That's where I think you're doing the NFL's argument a disservice. Even assuming for the sake of argument that the science is so close so as not to be sufficient to tip you either way, the texts, the timelines and the distinction between the Pats balls and the Colts balls that day mean something. And if you're the NFL and the guys that could exonerate themselves are instead destroying evidence, that means something as well.

There's enough corroborating evidence here to tilt in favor of the NFL, if even only slightly.

At the center of the NFL's report on its ruling is its claim that Brady destroyed evidence, leading Goodell to uphold his punishment.

“On or shortly before March 6, the day that Tom Brady met with independent investigator Ted Wells and his colleagues, Brady directed that the cell phone he had used for the prior four months be destroyed," the league's statement read. "He did so even though he was aware that the investigators had requested access to text messages and other electronic information that had been stored on that phone. ‎During the four months that the cell phone was in use, Brady had exchanged nearly 10,000 text messages, none of which can now be retrieved from that device. The destruction of the cell phone was not disclosed until June 18, almost four months after the investigators had first sought electronic information from Brady."

Brady, in turn, testified at his appeal hearing that it's common practice for him to get a new cell phone every few months and to destroy the previous one. From the NFL's report:

"At the hearing, Mr. Brady testified that it his practice to destroy (or give to his assistant to destroy) his cellphone and SIM cards when he gets a new cellphone. Mr. Brady also testified that, based on his typical practice, he would have asked to have the existing cellphone destroyed at or about the same time that he began using his new cellphone. According to records provided by Mr. Brady, he began using a new cellphone -- and based on what Mr. Brady and his cousel described as an ordinary practice, gave his old cellphone to his assistant to be destroyed -- on or about March 6, 2015, the very day that he met with Mr. Wells and his team to be questioned bout the tampering allegations."
That sounds like one hell of a coincidence.

The NFL contacted the cell phone service provider and was told that Brady's phone information could NOT be retrieved.


Now imo the only way that happens is if Brady's lawyers contacted the phone company and request the information to be destroyed.

It would be damn funny if yet again Patriot arrogance led Brady and co. to believe they could talk big and get Goodell to cower. Shit, it usually works...why not now? But when Brady's people came out and started leaking the 'lift it entirely or no deal' rhetoric, I have to think the NFL decided to stand firm.
