Kansas Governor Brownback signs 2nd Amendment Protection Act into law

The second amendment to the constitution of the United States reserves to the people, individually, the right to keep and bear arms as that right was understood at the time that Kansas was admitted to statehood in 1861, and the guaranty of that right is a matter of contract between the state and people of Kansas and the United States as of the time that the compact with the United States was agreed upon and adopted by Kansas in 1859 and the United States in 1861.

I like that he added any treaty in particular or other laws. That should cover Obamacare. But ya' know all the left needs is a well placed judge to knock it down. That's how the left plays the game...and we lose more and more freedoms.

There is nothing stopping Kansas from making its own constitutional amendment regarding the right to bear arms stronger than the US Constitutional 2nd Amendment.

This action does not accomplish a whole lot because any federal law would be presumed constitutional unless it is ruled to be unconstitutional by the federal courts.

Seems to me the only Second Amendment case involving federal law was the DC ban that was struck down in Heller. That was quite minimal and seems like a few state laws have been overturned by federal courts after the incorporation ruling in the Chicago case, but as far as I know, no other federal law or regulation has been overruled as violating the 2nd amendment.

Seems like a politician passing out placebo pills to that portion of the gun rights crowd that does not understand what the text really means under the law.

More and more of this type legislation is coming forth because states feel their rights are under attack and this is the only way they can assert themselves. Plus, inserting language of the statehood agreement is meaningful not a placebo.

Right, but any federal law would trump any state constitution, so that wouldn't accomplish anything in terms of protecting state residents from having their alleged rights violated by the feds.

That all depends on how serious Kansas, and other states that are passing this, really are about it. If they choose to say, "No, the court ruled wrong, and in direct opposition to the agreement we made when we became a state. We stand by the legislation we passed.", then it is a whole other ball game. Like civil war type ball.

We will see what happens, because that is what this going to come down to at some point. We will find out who was pandering, and who was serious.
