Just underwear. The Tom just wanted to leave. Marty like an idiot called the cops thinking the Tom would go to jail. Police wouldn't care that Marty smacked the guy around a bit. Did not work out that way. Marty was in trouble for hitting him & holding him there against his will until the cops came.
