The conversation between Cap and Fury sets up this stupidity. SHIELD is not the type of organization that would simply kill people because they "think" they might do something. Punishment, execution before a crime is even committed.

As for Helicarriers with better weapons to replace theirs, it was specificly stated that these would be unmanned, and controlled via satellite.

Fury: Once they go up, there's no reason for them to ever come down.

They weren't mobile bases like the one in Avengers. They were satellite controlled gun emplacements.
