That is statutory rape, Penal Code section 261.5, which covers unlawful sexual intercourse, and is not the same as "rape"...it does not involve forced sexual penetration without the victims consent, which is what you clearly intended to imply. It is a law that creates a statutory presumption that someone under 18 cannot legally give consent as a matter of policy, but it is riddled with exceptions, can be charged as a misdemeanor even when violated and a defense exists, where there is a good faith believe that the individual was at least 18 yo. Let's see, the alleged victim here was at a college party, and tells everyone she is 18. Yeah...pretty clear why the DA decided not to prosecute. No crime committed. Pretty easy to understand. What I think IS difficult is for you not to be a complete ****.
