Fox has Silver Surfer (and Galactus, and most characters related to the Fantastic Four). If it was Sony they might be able to work something out, but Fox and Marvel aren't on good terms. Marvel needs the Fantastic Four reboot to bomb hard to even have a chance of getting those characters back in the foreseeable future.
