That's too bad. Both my son and I have HD 8.9s and use them almost daily with no problems (mine was new Christmas before last and his was a refurb last fall).
Sucks you got a lemon.
I'm still trying to convince my boss that I need an iPad since all of our dealers and field guys use them. He did mention that a Surface might be in the cards.
