That looks terrible. That guy was an idiot for running out into traffic, but it sure sounds like Stewart gunned the throttle when he hit him.

He could say he didn't see the guy until the last minute and accelerated to try and avoid hitting him. Easy defense, hard to prove intent in my opinion :shrug:

I'm no driver myself, but I was listening to 610 and there were quite a few callers making the point that on dirt tracks like that you have to lay on the gas to AVOID things, and the breaks actually make you go straight.

Again, I'm no driver and I've never driven on dirt like that, but many people were making the point and nobody was arguing it.

When I saw his car had parked at the end of the video it made it seem like he stopped as soon as he hit him so I'd imagine he revved it to try to scare the kid to teach him a lesson.

No matter how you look at it, it looks bad.

The more you watch that the worse it looks. Stewart had room low to avoid the guy, it wasn't like he was trapped. And he clearly hit the accelerator when he ran him over too. I'm not sure you could prove in a court of law he hit him intentionally but it looks bad.
